KaiNet — Terms of Service
By accessing KaiNet ("the Service") you agree to these Terms. The Service is operated by Express Analytics ("we", "us", "our").

launch.
1. Eligibility & account
- You must be at least 18 and legally able to enter into a contract.
- You are responsible for the accuracy of the information you provide and for keeping your sign-in credentials secure.
- You may use the Service only on behalf of an organization you have authority to represent.
2. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or attempt to extract source data, agents, or models from the Service except as permitted by law.
- Use the Service to violate the policies of any connected ad platform (Google Ads, Meta, LinkedIn, etc.) or any applicable law.
- Use the Service to harass, defraud, or send unauthorized messaging.
- Resell, white-label, or sublicense the Service without our written consent.
We may suspend or terminate access for violations.
3. Connected ad platforms
The Service connects to third-party advertising platforms on your direction. When you connect such a platform you authorize us to read and write data on your behalf within the scopes you grant. You remain solely responsible for compliance with each platform's terms (including Meta Platform Terms and Developer Policies where Meta is connected).
You can disconnect any connected platform at any time from /profile. Doing so removes the saved access token from our side; the upstream platform may have additional revocation steps which we surface in our docs.
4. Your content & data
You retain ownership of all content you upload, generate, or authorize us to read on your behalf ("Customer Content"). You grant us a worldwide, royalty-free license to host, store, reproduce, modify, and use Customer Content solely as needed to operate the Service for you.
We process Customer Content according to our Privacy Policy.
5. AI-generated output
The Service uses third-party AI models (OpenAI, Google Gemini, etc.) to generate creative assets, perform analysis, and execute campaign actions. AI output:
- May be inaccurate, incomplete, or unsuitable for a given purpose. You are responsible for reviewing output before publishing it or executing it on a connected platform.
- Is not warranted to be original or non-infringing. You should review for IP and brand-safety concerns.
- Subject to the underlying model provider's usage terms.
6. Fees & billing
Paid plans and credit packs are billed via Stripe at the prices displayed in /billing. Charges are non-refundable except where required by law. We may change pricing prospectively with notice.
7. Intellectual property
The Service, including its software, agents, models, UI, and documentation, is owned by Express Analytics and protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL MEET YOUR REQUIREMENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY.

before public launch. EU/UK consumer law and California-specific
provisions may require additional language.
10. Indemnification
You will defend, indemnify, and hold us harmless from any claim arising from (a) your Customer Content, (b) your use of the Service, or (c) your violation of these Terms.
11. Termination
Either party may terminate at any time. On termination your access ends and we will delete your data per the retention provisions in the Privacy Policy, except where retention is required by law.
12. Changes
We may update these Terms. The "Last updated" date at the top reflects the current version. Continuing to use the Service after a material change constitutes acceptance of the new Terms.
13. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of San Francisco County, California.
